§ 1 - General

The following General Terms and Conditions (AGB) apply exclusively to the business relationship.

The AGB can be called up at any time on our homepage. You can download, save or print the text. The version of the AGB on our homepage is binding. Only insofar as we have expressly confirmed deviating agreements in writing shall these apply, but without effect for future business.

For the use of the shopping cart it is necessary to write cookies on your computer.


§ 2 - The order of goods, contract conclusion

The order is placed by sending us the completely filled out order form (shopping cart) and is binding. We will confirm your order immediately. Upon receipt of the confirmation, the contract between the company Rothenburger Bonbonmanufaktur GmbH, Birkenweg 5, D-73326 Deggingen and you is concluded.

The text of the contract will be stored and will be made available to you by e-mail on request.

There is no minimum order value.

Should a product not be available at the time of the conclusion of the contract, we will inform you immediately by e-mail or by telephone.

§ 3 - Delivery and shipping costs

The delivery is made to the address of the customer. The delivery is usually made by Hermes. We reserve the right to consider further delivery possibilities.

The indicated prices are in Euro including the legal value added tax. Postage and packing according to our offer. The invoice price is the list price valid on the day of delivery !

The delivery of the goods is carried out by Hermes.

If the goods are collected, no shipping costs will be charged. This must be communicated to us separately.

Usually the dispatch takes place within 4 days, provided that there are no weekends or holidays in this period.

All orders are provided by us as soon as possible.

We assume no liability for the adherence to a delivery date specified by you. This does not apply to delivery periods that have been assured in writing.

We make every effort to avoid partial delivery. We will inform you in advance of any partial delivery that is nevertheless reasonable.

§ Article 4 - Prices

The prices stated in the final invoice include the currently valid statutory value added tax, other taxes and price components.

Temporary offers are marked as such.

§ 5 - Payment and reservation of title

The purchase price is due upon collection.

The payment is made in advance and also cash on collection.

§ 6 - Warranty

We shall be released from the obligation to deliver and pay damages in the event of operational disruptions of any kind, difficulties in the procurement of goods, as well as force majeure.

The goods are transported at the risk of the recipient; please report any transport damage to the respective transport company immediately.

§ 7 - Revocation and return

Only perfect, unused goods can be exchanged. The goods remain our property until full payment has been received.

In case of a return you are obliged to pay sufficient postage for the shipment. The paid postage costs will be refunded by us by credit note.

We are not obliged to accept insufficiently franked shipments. Any costs incurred as a result shall be borne by you.

§ 8 - Data protection

As far as we collect and store personal data from you for the processing and execution of orders, these data are treated strictly confidential. We will not pass on your data to third parties. This does not apply to the partner companies involved in the processing of the contract.

You are aware and you agree that the personal data required exclusively for the processing of the order will be stored on data carriers.

You agree to the collection, processing and use of your personal data within the scope of business activities with the company Rothenburger Bonbonmanufaktur GmbH.

You can revoke this consent at any time with immediate effect for the future. In this case, we undertake to delete your personal data immediately, unless an order process has not yet been completed.
§ Section 9 - Final Clause

If individual provisions of these General Terms and Conditions are invalid, the validity of the other provisions shall not be affected and the contract and these General Terms and Conditions shall remain valid for both parties. Any invalid provision shall be replaced by a valid law.

§ 10 - Place of jurisdiction

German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods, even if the order is placed from abroad or if delivery is made abroad. The place of jurisdiction in all cases is Deggingen (Germany)


§ 11 - Information on online dispute resolution

The EU Commission provides a platform for online dispute resolution on the Internet under the following link: https://ec.europa.eu/consumers/odr/

This platform serves as a contact point for out-of-court settlement of disputes arising from online purchase or service contracts in which a consumer is involved.
